Terms of service

These terms are an agreement between you and Jake Ball Group, LLC, doing business as whskyqsr ("we", "us"), for using Fealty: the website at fealty.me, the web app at app.fealty.me and the Android app. By creating an account or using Fealty you agree to them, and to our privacy policy. If you don't agree, please don't use Fealty.

Who can use Fealty

You must be at least 18 years old, and old enough to agree to these terms where you live. You may not use Fealty if we've removed you before, or if the law where you are forbids it.

Consent comes first

Fealty is a tool for adults in power-exchange relationships that everyone involved has freely agreed to. Everything in a dynamic, including every task, rule, consequence and photo, must stay within what each person has agreed to, and anyone may withdraw their agreement at any time. Either person can leave a dynamic or block the other whenever they choose.

Fealty doesn't check or guarantee anyone's consent, identity or intentions, and it isn't a safety device. Talk about limits and safewords outside the app, and if you're ever in danger, contact local emergency services.

Your account

Keep your sign-in secure and your details accurate. You're responsible for what happens in your account. One account per person, and don't use anyone else's.

What you must not do

• Upload or share anything showing a person under 18, or anything sexualizing minors in any way.
• Upload or share images of anyone who hasn't agreed to be in them and to have them shared.
• Use Fealty to harass, threaten, coerce, stalk or exploit anyone, or to pressure them past what they've agreed to.
• Use Fealty for anything illegal, including commercial sex or trafficking.
• Share anyone's content outside Fealty without their permission.
• Interfere with Fealty: probe or break its security, overload it, scrape it, or get at accounts or data that aren't yours.

You can report a photo or a person from inside the app. We review reports, and we remove content and accounts that break these rules. We report child sexual abuse material to the National Center for Missing & Exploited Children and cooperate with law enforcement.

Your content

What you put into Fealty stays yours. You give us permission to store it, process it and show it to the people you share it with, only as needed to run Fealty for you. That permission ends when the content is deleted, except for copies other members keep as described in our privacy policy and backups that expire. You confirm that you have the right to share what you upload, including the agreement of anyone shown in a photo.

Our service

We work to keep Fealty running well, but we may change, add or remove features, and Fealty may sometimes be unavailable. We may offer paid features in the future; they will come with their own pricing, which you'll see and accept before you're charged. Fealty, its name, the Links mark and its design belong to us.

Ending your use

You can stop using Fealty and delete your account at any time in Settings. We may suspend or remove an account that breaks these terms or puts others at risk, and we'll tell you why unless the law or someone's safety stops us.

Disclaimers

FEALTY IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS. WE DON'T PROMISE THAT FEALTY WILL BE UNINTERRUPTED, ERROR-FREE OR THAT NO DATA WILL BE LOST, AND WE AREN'T RESPONSIBLE FOR HOW OTHER MEMBERS BEHAVE.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF FEALTY. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT FEALTY IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$50. SOME PLACES DON'T ALLOW THESE LIMITS, SO THEY MAY NOT ALL APPLY TO YOU.

Indemnity

If someone brings a claim against us because of content you shared or your breaking these terms, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.

Law and disputes

These terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Michigan, and you and we both agree to their jurisdiction. If you live somewhere whose consumer laws give you the right to bring a claim in your local courts or under your local law, nothing here takes that away.

Changes to these terms

We'll post any change here with a new date. If a change matters, we'll tell you in the app or by email before it takes effect. Using Fealty after that means you accept the new terms.

The rest

If part of these terms can't be enforced, the rest still applies. Not enforcing a term isn't giving it up. You can't transfer these terms to anyone else; we may transfer them if Fealty changes hands, and we'll tell you if we do. These terms and the privacy policy are the whole agreement between us about Fealty.
